What Is Question 8?

Question 8 would repeal laws that allow the sale, use, and possession of marijuana for recreational use. It would repeal laws allowing for the regulation of recreational marijuana, the state marijuana tax, and the potential for local option marijuana taxes. It would also repeal laws that permit the cultivation of marijuana in a personal residence.[1]

Under Question 8, the possession of up to one ounce of marijuana for people aged 21 and older would not result in any civil or criminal penalties. However, an individual could be subject to civil or criminal penalties if more than five grams of marijuana is in the form of marijuana concentrate. Question 8 would establish civil penalties for the possession of between one and two ounces of marijuana for people aged 21 and older, and of up to two ounces of marijuana for people aged under 21.
